Gestern, am 21.04.2019 kam es im UKE zu einem gewalttätigen und lebensgefährlichen Übergriff durch drei Security-Kräfte gegen einen Patienten aus Kamerun. Nachdem er danach eine Stunde reanimiert werden musste, liegt er seitdem im künstlichen Koma und wird laut Auskunft an seine Verwandten in kritischem Zustand mit sehr begrenzten Lebenschancen verbleiben.
Augenzeugen sagten aus: “Gestern Morgen weigerte er sich, die ihm wegen einer psychischen Erkrankung verordneten Medikamente einzunehmen. Er saß draußen und entspannte sich. Er hatte kein aggressives Verhalten gezeigt als ihn die Sicherheitsdienst-Kräfte anpackten und ihn zu Boden warfen” und weiter, dass er getreten wurde, bis er das Bewusstsein verlor. Ein Arzt versuchte, ihn wiederzubeleben, und er wurde dann in einem Krankenwagen in die Notfall-Intensivstation des UKE gebracht.
Leider ist dies kein Einzelfall. Solche Begegnungen finden viel zu oft statt und spiegeln die rassistische und menschenverachtende Wahrnehmung gegenüber Schwarzen Menschen als aggressiv und gewalttätig wider, denen unabhängig von äußeren Umständen oder persönlichen Situationen eher mit tödlicher Gewalt als mit Mitgefühl begegnet werden muss.
Herr Tonou-Mbobda wurde freiwillig in den offenen Bereich der Psychiatrie-Klinik aufgenommen und hätte dementsprechend auch jederzeit die Klinik wieder verlassen können. Es ist erlaubt und normal, dass Patienten auf dem Gelände ausgehen.
Außerdem gibt es neben den verfassungsmäßigen Rechten auf Selbstbestimmung und körperliche Unversehrtheit auch die höchstrichterliche Rechtsprechung, dass eine Zwangsbehandlung gegen den ausdrücklichen Willen des Betreffenden grundsätzlich nur mit einem richterlichen Beschluss möglich ist.
Außerdem gibt es neben den verfassungsmäßigen Rechten auf Selbstbestimmung und körperliche Unversehrtheit auch die höchstrichterliche Rechtsprechung, dass eine Zwangsbehandlung gegen den ausdrücklichen Willen des Betreffenden grundsätzlich nur mit einem richterlichen Beschluss möglich ist.
Wir fordern
* eine Erklärung der UKE über den Zustand und die Gesundheit von Herrn Tonou-M, sowie umfassende rechtsmedizinische Aufklärung des Vorfalls
* eine sofortige Suspendierung und Ermittlungen gegen die beteiligten Sicherheitskräfte
Derzeit arbeiten Vertreterinnen der Black Community unter Rücksprache mit den Verwandten am weiteren Vorgehen.

Yesterday, 21 April 2019, three security forces attacked a patient from Cameroon in the UKE in a violent and life-threatening attack. After being resuscitated for an hour, he has been in an artificial coma ever since and, according to his relatives, will remain in a critical condition with very limited chances of survival.
Eyewitnesses testified: "Yesterday morning he refused to take the medication prescribed to him because of a mental illness. He sat outside and relaxed. He had shown no aggressive behavior when the security forces "grabbed him and threw him to the ground" and further that he was kicked until he lost consciousness. A doctor tried to resuscitate him, and he was then taken in an ambulance to the UKE Emergency Intensive Care Unit.
Unfortunately, this is not an isolated case. Such encounters take place far too often and reflect the racist and inhuman perception of black people as aggressive and violent, who must be met with deadly violence rather than compassion, regardless of external circumstances or personal situations.
Mr. Tonou-Mbobda has voluntarily admitted himself to the open section of the psychiatric clinic and could have left the clinic at any time. It is permitted and normal for patients to go out on the premises.

Hier, 21 avril 2019, trois forces de sécurité ont attaqué un patient camerounais dans l'UKE lors d'une attaque violente et mettant sa vie en danger. Après avoir été réanimé pendant une heure, il est dans un coma artificiel depuis lors et, selon ses proches, il restera dans un état critique avec des chances de survie très limitées.
Des témoins oculaires ont témoigné : "Hier matin, il a refusé de prendre les médicaments qui lui avaient été prescrits à cause d'une maladie mentale. Il s'est assis dehors et s'est détendu. Il n'avait montré aucun comportement agressif lorsque les forces de sécurité "l'ont attrapé et l'ont jeté à terre" et qu'il a reçu des coups de pied jusqu'à ce qu'il perde connaissance. Un médecin a essayé de le réanimer, puis il a été transporté en ambulance à l'unité de soins intensifs d'urgence de l'UKE.
Malheureusement, il ne s'agit pas d'un cas isolé. De telles rencontres ont lieu beaucoup trop souvent et reflètent la perception raciste et inhumaine des Noirs comme étant agressifs et violents, qui doivent être traités avec une violence mortelle plutôt qu'avec compassion, indépendamment des circonstances extérieures ou des situations personnelles.
M. Tonou-Mbobda s'est volontairement admis dans la section ouverte de la clinique psychiatrique et aurait pu quitter la clinique à tout moment. Il est permis et normal pour les patients de sortir sur place.
Outre les droits constitutionnels à l'autodétermination et à l'intégrité physique, il existe également une juridiction suprême selon laquelle le traitement obligatoire contre la volonté expresse de la personne concernée n'est possible que sur décision judiciaire.
